WHO WE ARE AND OUR CONDITIONS

These general conditions of sale (the "General Conditions") regulate the offer and sale of products on the site https://www.aquavitae.shop (the "Site") owned by the company Sapore Divino Srl, with registered office in Via del Canale della Lingua n. 192, Rome, registration number in the Register of Companies of Rome and VAT number 10008461005, REA-RM 1203044 (the "Company").
The sale of products through the Site is qualified as a distance contract pursuant to Chapter I, Title III (articles 45 et seq.) Of the Consumer Code (Legislative Decree 6.09.2005 n, 206) and Legislative Decree 09.04.2003 n. 70 on electronic commerce.
The Company reserves the right to modify or update the General Conditions at any time. The amended General Conditions will be applicable to all purchases subsequent to their publication on the Site

   REGISTRATION
It is possible to visit the Site and view its content freely and for free, without registering.
For the use of the services and to proceed with the purchase of the products offered, free registration on the Site (the "Account") is required. In order to register, the user must provide truthful, exact, complete and up-to-date information. The User will receive all the information necessary to complete the registration operation.

Each registered user (the "User") is responsible for all activities relating to their Account, as well as for maintaining the confidentiality of their password.
In the event that the User becomes aware of any unauthorized use of their registration information, the User agrees to immediately notify the Company of such circumstance.
It is the User's care and commitment to promptly notify the Company of any changes concerning the e-mail address with which he registered or of any other information useful for proceeding with the delivery of the ordered products.
If the Company finds violations of these General Conditions, it may, at its discretion, inhibit access, permanently delete the information contained therein or refuse the opening of new Accounts by the same User.
At any time, the User can update and / or modify or request the cancellation of the information released during registration and / or of his / her Account. In the event of a request for cancellation, the Company may keep this information, in whole or in part, for a limited period of time, for the sole purpose of executing any purchases made and / or being able to conclude the accounting and tax procedures.
  PURCHASING RULES AND INFORMATION

PRODUCTS
The Site sells alcoholic products, food and accessories and is aimed exclusively at Users who have reached the age of 18. The User who makes purchases on the Site undertakes to indemnify the Company from any liability in the event that such purchases have been made in violation of the current regulations regarding purchase limits for reasons of age.

It is not excluded that the information sheet relating to each product on the Site contains one or more clerical errors (eg availability, price). In these cases, or in similar cases, the User can request the cancellation of the order.
The information and images on the Site are protected by the legislation on intellectual property and copyright. It is expressly forbidden for the User to copy and / or download and / or share, process, transfer to third parties or create derivative works in any way from the contents, including those of third parties, available on the Site, nor allow third parties to do so through the 'User or his device, even without his knowledge.
The validity of the offers may be subject to quantitative or temporal limitations, after which they may no longer be available. 
The products on the Site are limited in number. It is not excluded that multiple Users purchase the same product at the same time and that this is no longer available following the transmission of the purchase order. In this case, the User will be promptly informed by e-mail or by telephone. The User can then terminate the contract by canceling the order and the Company will refund the relative purchase amount without delay and, in any case, within a maximum period of 15 working days from the date of collection. This amount will normally be credited to the same payment method used by the User for the purchase. The Company will not be responsible for any delays in crediting depending on the payment method selected by the User.

PLACING AN ORDER
Once registered, the User must fill in the order form paying attention to the information entered and send it to the Company following the instructions that will appear on the Site from time to time. The order will be considered placed with the confirmation of the same and is subject to payment of the price, including any shipping costs.
The contract will be concluded with the receipt of the order by the Company.
Subsequently, the User will receive, to the e-mail indicated in the relative order, an order confirmation, summarizing the information relating to the characteristics of the product purchased, the price paid, the delivery times and the contact of the Customer Service for any requests for support. 
Orders will be processed from Monday to Friday; if orders are placed on Friday, they will be processed only if received by 10.00.

  PRICES AND PAYMENTS
PRICES
All product prices are expressed in Euros and are inclusive of VAT, unless otherwise indicated.  
The price of the products can be changed by the Company at any time and without notice; in any case, the price charged to the User will be the one published on the specific product information sheet at the time the order is sent.

SHIPPING FEES
Shipping costs can be fixed or variable, calculated on the basis of the total value of the purchases, or free in the event that the total amount of the order exceeds a certain value or following a specific promotion. 
The User is always informed of the total amount of shipping costs before concluding the purchase procedure and sending the order form. 
PAYMENTS 
The payment of the products can be made by credit card, debit card through the main accredited circuits (Visa, Mastercard, Nexi, etc.), PayPal or other digital payment systems (eg Amazon Pay, etc.).
Payments by bank transfer are also accepted. In this case, the bank details (IBAN), the amount of the transfer and the relative order number will be indicated with the order confirmation. Payment by bank transfer must be made within the indicated terms and in any case no later than three days from the order confirmation; after this deadline it may not be possible to guarantee the evasion of the products. In this case, any payment received after the deadline will be credited at no additional cost and by bank transfer.
SECURITY IN TRANSACTIONS
The Company does not keep any payment data of the User; all information will be managed directly by the payment system provider.
The Company uses security systems and certificates in line with the best security standards to allow the User to make their purchases in peace. 
The Company has no responsibility for any refusal of payment by the User's chosen payment circuit and cannot therefore be held responsible in any way for direct or indirect consequences deriving from the use of the credit card by the user to perform the payment of the products and / or services purchased.
The Company never has access to and does not store your credit card details 
Payments via Paypal or other digital payment systems are made directly on the relevant sites and the terms and conditions applied therein will apply.
  SHIPPING AND DELIVERY
Delivery times are indicated in the cart summary or in the product information sheet. 
Please note that delivery times are only indicative and are calculated from the day of shipment; the Company is not responsible for any delays due to the courier in charge of delivery, for customs clearance problems or other causes due to third parties or force majeure. In any case, our Company will do everything possible to reduce or limit any inconvenience to the User.
The shipment is usually made within 24-48 hours from the order date for products available for immediate delivery. As soon as the package is delivered to the courier, its electronic traceability begins and the day of arrival is estimated. 
Upon delivery, the User must check the conditions of the product that has been delivered to him. 
The User is advised to check the correspondence of the products to the order placed, that the packaging is intact, not damaged or in any case altered, and he is invited to immediately contact the Customer Service for the appropriate reports, even in the event of anomalies. , and to initiate - if necessary - the necessary return or replacement procedures.
We remind you that the risk of loss or damage to the products, for reasons not attributable to the Company, is transferred to the User when the user, or a third party delegated by him and other than the carrier, materially comes into possession of the product.

RIGHT OF WITHDRAWAL
If the User is a consumer pursuant to the Consumer Code, he / she may exercise his / her right of withdrawal under the terms and conditions indicated below.

The Company will provide the User with all the instructions necessary to proceed with the return of the products, at the expense of the same. It is advisable to use the original packaging and to take the necessary measures to avoid possible damage.
The User must clearly insert in the packaging the details relating to the order necessary to identify the return at its destination, as per the Company's instructions.
The products must be kept, handled and returned intact, complete in all their parts, accompanied by all the original accessories and labels, where present, still attached and not tampered with, as well as perfectly suitable for their intended use and free of signs of wear or dirt.
The User is responsible for any decrease in value resulting from handling the product other than that necessary to establish the nature, characteristics and correspondence to the order. In this case, the Company, upon written notice to be sent to the User within 5 working days of receipt of the returned products, may reduce the amount of the refund due to this decrease in value or, in the event that the refund has already been made , will send the bank details to allow the User to refund the difference.
The right of withdrawal is excluded only in the cases expressly provided for by article 59 of the Consumer Code.

For orders placed using the Paypal, Nexi or Payway payment methods, the expenses will be reimbursed net of commissions, or the transition commission will be deducted based on the payment method used.

CONFORMITY GUARANTEE

Pursuant to articles 128-135 of the Consumer Code, the User who purchases as a consumer has the right to guarantee the conformity of the products and services purchased within the limits of 24 months from the purchase provided that communication is given within 2 months since their discovery.

The User must contact the Company providing an accurate description of the defect found. If the lack of conformity of the product is ascertained, the User has the right to obtain, at his choice, the repair or replacement of the product, or an appropriate reduction in the price or the termination of the contract in the following cases:

if the replacement repair proves impossible or excessively burdensome;

if the Company has not repaired or replaced the asset within a reasonable period, in any case not less than 15 days;

if the replacement or repair previously carried out has caused significant inconvenience to the User.

However, the User is obliged to return the defective products.

Notwithstanding the foregoing, please note that the images on the Site are merely indicative of the products themselves. Furthermore, the Company verifies the actual suitability of its suppliers and partners to supply the products in the quantities and according to the characteristics described on the Site, but does not guarantee the completeness of the information or the perfect correspondence of the descriptions provided by its suppliers.

APPLICABLE LAW AND DISPUTE RESOLUTION

The General Conditions are subject to Italian law.

For any dispute regarding the interpretation, execution and / or termination of the contract between the User and the Company, the Court of the User's place of residence or domicile will be competent, in the event that he is a consumer pursuant to the Code of Consumption, or the Court of Rome in the event that the User is not a consumer.
